Terms and conditions

  • 1. The promotion runs from 9 am on 27th March 2017 until 11.59pm on 5th May 2017 (“Closing Date”).
  • 2. The promotion is open to UK residents aged 18 or over, excluding employees of the Promoter (or any other company within the Saint-Gobain group) (an “Employee”), an Employee’s immediate family, their agents or anyone else professionally connected with this promotion.
  • 3. To participate in this promotion, entrants must submit the details of their nominated community building project (the “Project”) via www.buildingbettercommunities.co.uk (the “Website”) or www.facebook.com/jewsonUK (the “Facebook Page”) and complete all required details prior to the Closing Date. Entry by any other means will not be accepted.
  • 4. Acceptance of these terms & conditions is a condition of entry.
  • 5. There are three prize levels on offer with this promotion and when making their entry via the Website or the Facebook Page, entrants will be asked to select which prize they are seeking, ie. the Trade Hero Prize, the Top Regional Prize or a Regional Prize (all as defined below).  All entries for a Regional Prize shall be considered for the Top Regional Prize and any Project that is unsuccessful for the Top Regional Prize shall in all circumstances be considered for a Regional Prize.  Entries for the Trade Hero Prize will only be considered for the Trade Hero Prize.
  • 6. The trade hero prize is the sum of fifty thousand pounds (£50,000) (the “Trade Hero Prize”) to be provided in the form of building materials from the Promoter.
  • 7. The top regional prize  is the sum of fifty thousand pounds (£50,000) (the “Top Regional Prize”) to be split with twenty five thousand pounds (£25,000) being provided in building materials from the Promoter and the remaining twenty five thousand pounds (£25,000) to be provided as a contribution towards labour and other project costs as agreed with the Promoter.
  • 8.  There is a further regional prize fund (the “Regional Prize Fund”) consisting of a total of one hundred and fifty thousand pounds (£150,000) which will be split into prizes of between five hundred (£500) and ten thousand pounds (£10,000) (in varying denominations) worth of building materials from the Promoter (the “Regional Prize(s)”). When applying for a Regional Prize, the entrant must state what amount of the Regional Prize they are seeking although in the event that they are successful, the Project may not be awarded the full amount that is included in the entry (the value of the Regional Prize that is awarded will be a decision for the Panel (as defined below) whose decision shall be final and no correspondence will be entered into). The Regional Prizes will be issued to one winner out of each of the 11 regions of Great Britain (the 11 regions consist of East of England, East Midlands, London, North East, North West, Yorkshire and the Humber, South East, South West, West Midlands, Wales and Scotland (the “Regions of Great Britain”)). Any remaining funds from the Regional Prize Fund will be allocated at the Promoter’s discretion to other entries that are considered to be deserving of a prize (for the purposes of these terms and conditions, these prizes shall also be referred to as Regional Prizes).
  • 8. The Trade Hero Prize, Top Regional Prize and the Regional Prizes shall together be referred to as the Prize(s).
  • 9. What building materials will make up a Prize will be as chosen by a representative of the relevant winning Project (as defined below) following discussion with their local Jewson branch (subject to availability).  The value of the building materials making up a Prize will be a discounted price from the VAT inclusive list price of such materials as advertised by the Promoter.  The Promoter’s decision on this is final and no correspondence will be entered into.
  • 10. The Trade Hero Prize, Top Regional Prize and Regional Prizes will be allocated following a three stage judging process (the “Judging Process”).  The Judging Process will involve the following criteria (the “Criteria”):

Legacy The lifespan of the Project and how much it will continue to have an impact into the future.
Sustainable products The amount of sustainable products which have been identified (or could be used) for the Project.
Impact of project How many people this will impact in the local community – size of location to be considered (e.g., preference should not necessarily be given to more densely populated areas).
Strength of application The effort and level of detail included in the entry.
Proximity of location How close the Project is to a Jewson site.

Stage one of the Judging Process

  • 11. For stage one of the Judging Process, the Promoter will use the Criteria to select which Projects will take part in stages two and three of the Judging Process. Stage one of the Judging Process will take place within two weeks of the Closing Date.

Stage two of the Judging Process

  • 13. The Projects that successfully make it through stage one of the Judging Process will be uploaded to the Facebook Page to allow stage two of the Judging Process to take place.  Between 22nd May 2017 and 16th June 2017 (the “Voting Period”) people will be invited to submit their vote through the Facebook Page as to which Project is their favourite to win the Trade Hero Prize, and also their favourite to win a Regional Prize.  A maximum of one vote for each of the Trade Hero Prize and a Regional Prize per Facebook account is permitted. Each vote will count as one mark for that Project.

Stage three of the Judging Process

  • 14. At the end of the Voting Period, stage three of the Judging Process will commence.  This will consist of a panel made up of both internal representatives from the Promoter and external representatives (the “Panel”) that will award marks in accordance with the Criteria (there is a maximum of 10 marks available per Criteria)).  The Panel’s decision shall be final and no correspondence shall be entered into.
  • 15. Equal weighting shall be given to both stage two and stage three of the Judging Process.  Fifty percent of the overall mark will be achieved in stage two of the Judging Process and fifty percent of the overall mark will be achieved in stage three of the Judging Process.  The results of stage two and stage three of the Judging Process shall be added together to reach the final overall mark.  The winner of each of the Trade Hero Prize and the Top Regional Prize shall be the Project that achieves the highest final overall marks within the relevant category.  The Regional Prize winners will be those Projects that achieve the highest final overall marks in each Region of Great Britain (after excluding the Project that has been awarded the Top Regional Prize).  The number of Projects to receive a Regional Prize will depend upon the value of the Regional Prizes that the Panel elect to award but as a minimum will cover each of the 11 Regions of Great Britain.
  • 18. All entrants who submitted Projects that are awarded a Prize will be invited to an award ceremony on   5th July 2017 to be notified of their Prize(s) so long as suitable contact details were provided at the point of entry. If following notification of being a winning Project, no contact is made by the entrant and or an alternative representative for the Project with the Promoter and/or the allocated Jewson branch within seven (7) days, the Promoter may withdraw that particular Prize and instead award it to the next Project who would have been allocated a Prize in accordance with the overall marks allocation.
  • 19. The entrant is the individual submitting the entry. The Prizes are awarded to the winning Project(s) and not the entrant. The entrants themselves shall have no claim to the Prize or any part thereof.
  • 20. The Trade Hero Prize, twenty five thousand pounds (£25,000) of the Top Regional Prize and each Regional Prize will be added to a Jewson account (to be opened in the name of the relevant winning Project) to allow the associated Project to draw down the building materials that they require for their Project. The intention is to allocate the most convenient Jewson branch and an appropriate point of contact to each winning Project to assist the Project in making the best use of the Prize.  Any supply of materials through the Prize or through a Jewson account will be subject to the Jewson Limited terms and conditions of sale (please see http://www.jewson.co.uk/media/8234444/Terms%20and%20Conditions%20of%20Sale.pdf ). Once the entirety of the Prize has been used, any further purchases through a Jewson account will need to be paid for in cash or alternatively, it may be possible to open a credit account (please contact your local Jewson branch manager for details). The Prize winners have a maximum of 12 months from 5 July 2017 to use the Prize that has been awarded to them and added to a Jewson account. Following this date, the Prize that has been added to the Jewson account will be withdrawn and the balance of that Jewson account set to £0.
  • 21. Details of the winning Projects will be available by sending a stamped addressed envelope to Building Better Communities, Marketing Department, Merchant House, Binley, Coventry CV3 2TT.
  • 22. No responsibility can be accepted for lost, damaged or incomplete entries and the Promoter accepts no liability for entries received after Closing Date.  All entries through third parties or agents are invalid.
  • 23. Prizes are not transferable and no cash alternative is available.
  • 24. In the event of unforeseen circumstances or circumstances outside of its control, the Promoter reserves the right to offer an alternative Prize(s) of equal or greater value.
  • 25. Accepting a Prize may give rise to a tax liability which will be the winner(s) responsibility.
  • 26. Any queries regarding the Prizes, the Criteria or the Judging Process should be sent to jewsonbuilds@jewson.co.uk.
  • 27. In relation to this promotion:
    • a. Nothing in these terms and conditions shall exclude or limit the Promoter’s liability for death or personal injury caused by their staff or supplier’s negligence or for fraud.
    • b. Subject to clause 27a, the Promoter does not accept responsibility for any fault, malfunction, damage, loss or disappointment suffered by an entrant and/or a winning Project howsoever arising from entering the promotion or accepting any Prize whether due to any error, omission or other caused by the Promoter or its employees, agents or others.
    • c. Subject to clause 27a, the Promoter is not responsible for any damage or loss caused to an entrant and/or winning Project (i) which is not reasonably foreseeable to the entrant and/or winning Project and to the Promoter when the entrant and/or winning Project agrees to these terms and conditions (which occurs automatically when the entrant participates in this promotion) or (ii) is reasonably foreseeable to the entrant and/or winning Project and to the Promoter when the entrant and/or winning Project agrees to these terms and conditions but is only indirectly related to the entrant and/or winning Project participating in this promotion.
    • d. Subject to clause 27a, the Promoter reserves the right to amend any element of this promotion, or foreclose this promotion and cannot be held responsible for failure to deliver for reasons beyond its reasonable control, including but not limited to strike, lock-out, labour dispute, illness, act of God, natural disaster, adverse weather conditions, war, riot, civil commotion, accident, epidemic or pandemic, malicious damage, fire, flood and/or storm, compliance with law or governmental order, rule, regulation or direction, breakdown of plant, machinery or transportation. The Promoter is not responsible for any loss or damage caused to the entrant and/or winning Project as a result of any of these occurrences.
    • e. The entrant agrees to reimburse the Promoter in respect of any damages or any losses suffered by the Promoter resulting from any claim made by a third party in each case in respect of any matter arising from the entrant’s and/or winning Project’s participation in the promotion in breach of these terms and conditions or from the entrant’s and/or winning Project’s violation of any applicable law or regulation.
  • 28. Entrants must ensure that any person or persons whose image has been used in the project entry has given valid consent for the use of their image or has waived any rights they may have in the images, videos or other media submitted. Entrants must also ensure that anyone who is running the Project which is being submitted have consented to their project being nominated to take part in this promotion. Failure to provide this consent to the satisfaction of the Promoter may result in the entrant’s and/or the winning Project’s disqualification from the promotion and the forfeiture of the Prize. By entering this promotion, you warrant that any information or material which you submit to this promotion will not infringe the intellectual property, privacy or any other rights of any third party, and will not contain anything which is libellous, defamatory, obscene, indecent, harassing or threatening. The Promoter reserves the right, but not the obligation, to screen, filter and/or monitor information provided by you and to edit, refuse to distribute or remove such information.
  • 29. In consideration of the Promoter granting entrants a right to enter the promotion, each entrant automatically hereby grants to the Promoter an irrevocable, exclusive, royalty-free, world-wide licence for the full period of copyright to use, alter, adapt or sub–licence such rights to any third party the images, videos or other media submitted by the entrant in respect of the promotion, in any and all media. You agree to waive any moral rights you may have in the images, videos or other media submitted by you. Where relevant, you agree upon the Promoter’s request to assign to the Promoter any copyright subsisting in any entries you make to the promotion. All entries are printed / displayed at the Promoter’s discretion and may be edited for publication.
  • 30. It is a condition of entry that winners cooperate fully for publicity purposes if so required. By entering this promotion, the entrant agrees for their details and photograph to be included in future publicity material if required.  The entrants must also ensure that anyone who is running the Project which is being submitted have consented to their details and photograph and details and photographs of the Project to be included in future publicity material if required. Failure to provide this consent to the satisfaction of the Promoter may result in the entrant’s and/or the winning Project’s disqualification from the promotion and the forfeiture of the Prize.
  • 31. The Promoter reserves the right to alter, amend or foreclose this promotion without prior notice in the event that unforeseen circumstances make this unavoidable. The Promoter reserves the right to disqualify any entrant and/or select an alternative winner in the event the Promoter believes that any entrant has contravened any of these terms and conditions.
  • 32. The Promoter’s decision is final and binding and no correspondence will be entered into.
  • 33. An entrant’s personal data will be used by the Promoter for the purposes of administering this promotion.  If an entrant ticks the box at the point of submitting its details to enter this promotion consenting to being contacted by email, SMS or social media, the Promoter (including its group companies and its and their various trading styles (an “Associate”)) or a third party may send the entrant information by email or social media about news, offers, goods and/or services that the Promoter and/or an Associate feel may be of interest to the entrant.  Any personal data submitted will be used solely in accordance with current UK data protection legislation and the Promoter’s privacy policy [http://www.jewson.co.uk/about-us/legal-policies/privacy-policy/].
  • 34. English law applies and the exclusive jurisdiction of the English Courts shall prevail.
